FSA to Decide Whether to Investigate Insurers’ Practice of acting for non policyholders through ‘third party capture’. PDF E-mail

The FSA are currently looking into the insurers’ practice of acting for non policyholders through ‘third party capture’.

It is understood that the FSA is currently undertaking ‘exploratory work’ to gather information on this issue.

This issue will consider the practice of insurers contacting and dealing directly with members of the public who have been for example injured in a collision with a motor insurance policy holder. The insurer contacts the third party and suggests that they might wish to settle the claim without the involvement of a lawyer.

Linda Riordan MP, has pressed the FSA to regulate Insurers when they deal directly with members of the public.

Although this relates to Personal Injury cases it could have an effect upon non fault third party capture for Bodyshops and whether Insurers can steer members of the public into their approved repairer network.
